Any use of this website and any order placed with Hard To Find Records (HTFR) are conditional on your acceptance of our terms and conditions which are detailed below or are available on request. We reserve the right to amend our Terms and Conditions from time to time without notice and at our discretion - it is your responsibility to review these stated Terms and Conditions at regular intervals and before placing your order. We reserve the right to amend, modify, discontinue or suspend all or part of this website and may restrict your access to all or part of the site at any time without notice or liability. By placing an order with us you are agreeing to the following Terms and Conditions of sale: Telephone calls may be recorded for training, regulatory or quality purposes. We do not collect or capture ANY of your financial data, we will never collect sensitive information about you without your explicit consent or as required to process your order or as required by English law.

Orders placed with us are processed in British Sterling and in the English language. Any matters relating to the Hard To Find Records website or your order shall be governed by English law.


2. Products & Orders


All our products are new and unused, unless clearly stated otherwise.

We make every effort to ensure the products we supply are of the highest quality, reach you in good condition and are delivered promptly.

If for any reason you are unhappy with your purchase or the service you have received from us, please contact us by using our contact us page.

All orders are accepted subject to availability of stock at the time of picking the order.


3. Product Description


All photographs, descriptive matter, specifications and advertising are for the sole purpose of providing illustrations and approximate descriptions only.

A more detailed explanation can be obtained by contacting our sales department. This explanation will be based on our own independent knowledge and is opinion only.

Unless we are specifically asked about requirements or compatibility, we shall assume the customer already has this knowledge.

Manufacturers of the products we sell reserve the right to amend their product specifications without prior notice.

Our stock of records and CDs are a mixture of new stock and second-hand but all are fully guaranteed.

Due to the nature of second-hand records and CDs, some items may contain wear (e.g. surface scratches or less than brand new covers) but this should not affect the playability of the record.

We do not grade the condition of sleeves. Our grading system is an indication of the vinyl only.

Please assume any digital download codes have already been used.


4. Product Guarantees


Products are not supplied on a trial basis.

Everything we sell is guaranteed to be in new condition or match the condition as per our product description.

Photographs displayed are for the purpose of approximate descriptions only and are in no way implied to be the exact product we are offering or providing.


5. Selling Prices


We reserve the right to amend our prices without prior notice.

Prices are correct at the time of publication or upload to our website.

We are not obliged to supply goods to you until we have confirmed acceptance of your order. The acknowledgement email you may receive does not constitute order confirmation or acceptance.

We will not be obliged to honour any orders where there has been an obvious computer error, systems error or if our computer systems have been hacked or compromised.


6. Purchasing From Us


We are unable to process your order until your payment has been received, your Credit / Debit / Charge card has been authorised or proof of address verified.

PayPal payments may require time to clear (e.g. PayPal eCheques). The order will not be shipped until the payment has cleared.

By submitting your order, you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying those goods (including passing your personal details to couriers and other subcontractors). Your personal details can be removed from our system on request.

No items or title of goods shall pass from us to the customer until payment has been received in full.

Customers are responsible for the suitability of the goods they are purchasing. If any product supplied is not used for its intended purpose, subjected to abuse or unreasonable usage will void the warranty on the goods and our returns policy.

Customers may use our currency converter as an estimate only. Please contact your bank, PayPal or your card issuer for their exact exchange rate and/or any other charges as these are beyond our control.

We generally do not reserve any items as it is unfair to other customers.

No stock will be allocated to you until payment is received in full. Stock will not be held while we await correspondence from the customer.

All orders are subject to availability.


7. Availability Of Goods


We go to great lengths to ensure that everything shown on our website and catalogue is available to order and/or is in stock. However, due to the nature of our business dealing in rare products, it is inevitable that from time to time we may go out of stock. We are also sometimes dependent on our own suppliers to deliver stock to us.

In the unlikely event that a part of your order is out of stock, we will dispatch the available items, and process a refund for the remainder of your order.


8. Credit / Debit / Charge Cards


We do not collect or capture ANY of your financial data.

Credit, Debit and Charge cards are accepted without surcharge.

We reserve the right to deliver any order to the cardholders billing address in the interests of protecting both the card holder and this company against fraud.

In the interests of protecting all our customers against fraud, you may be asked to provide us with proof of your address at any time. If you refuse to provide us with this evidence, your order may be cancelled.

If you are using a Credit Card that does not belong to you, you must give the cardholder's full name and address. We will then contact the cardholder to obtain approval and commence other security checks.

Orders not sent to the card registered address are sent at the customer’s liability due to the higher risk of card fraud and the increased risk of a third party obtaining your delivery.

The use of stolen credit cards will result in international police notification and court action in all cases.


9. Card Payment Declines


Should your card payment be declined please be aware that this is entirely a decision by your bank. It is your responsibility to contact your card issuer to resolve any issues.


10. Shipping


All orders are shipped in sturdy, tested, environmentally friendly packaging. Where possible, orders can be tracked online from your website account or by contacting us.

We will attempt to ship all orders the day they are received. Same day dispatch cut-off time is 4:00pm GMT (we are closed Saturday, Sunday & Bank Holidays). Any orders placed after that time may not be shipped until the following working day.

If your order is shipped to a commercial premises, shared address, or parcel collection point, we do not accept liability for loss or damage to the goods once they have been delivered.

We advise you to ensure somebody is present at the delivery address since most orders require a signature upon delivery. Once goods are delivered and signed for they become your responsibility.

In the unlikely event that your order is lost or damaged in transit, a replacement order will be issued. If we can't offer an identical replacement, you will be offered a refund, store credit or an exchange free of charge.

If your order does not arrive, you must notify us of this within 14 days of the order being placed.

COVID-19 UPDATE

In light of the coronavirus outbreak (COVID-19) couriers may now take a photograph of the parcel in the doorway as proof of delivery instead of a signature.

We reserve the right to alter the shipping method for an order if we deem it appropriate.


11. Shipping Times


Our orders are handled and shipped by third party couriers, therefore all delivery dates and times given are only estimates.

We will endeavour to get your order to you within the estimated delivery time. On rare occasions your delivery may be delayed. We cannot be held responsible for unforeseeable delays by the courier / postal service or for any consequential losses you may suffer if the delivery is not on time.

Shipping times to remote locations may exceed the estimated shipping times stated on our website, and may occasionally be subject to delays.

Some items may have special shipping requirements due to size, weight, and / or value. In such cases, shipping times may exceed those stated at the point of purchase.

If your order does not arrive by the estimated delivery date, please contact us.

We reserve the right to amend our shipping prices at any time.

Business to Business purchases may have special shipping requirements. As such, the shipping estimates on the Hard To Find Records website do not apply to B2B purchases. For a more accurate B2B shipping estimate, please contact us.


12. Shipping Charges


Shipping charges are calculated by our website when you place an online order. A shipping quote can be obtained from our sales team for in store and telephone orders.

If your order is returned to us undelivered and we find no fault with the courier or Hard To Find Records then you will be responsible for re-shipping charges.


13. Online & Distance Selling - Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013


The legislation and regulations described here only apply to purchases made within the UK.

Returns Policy:

If you have taken delivery of your order and are unhappy with any of the products received, for any reason, we will be happy to refund or exchange any items providing you meet the following criteria:

- You must inform us of your desire to return any item within 14 days of receipt as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- All items must be returned to us in their original unopened condition.
- All items must be returned complete in their original packaging with any accessories or free gifts.

Unless the item is faulty, not as described, delivered in error or damaged upon delivery, you are responsible for the shipping costs when returning the item back to us. We recommend using appropriate, sturdy packaging, and a tracked, insured delivery service from a reputable courier. The item must be returned and delivered in its original condition to qualify for a full refund. Please note that we are not responsible for breakages or non-delivery by your courier.

International return shipments must be declared as Returned Items. This is to avoid confusion at customs and avoid unnecessary customs fees. We will not cover any costs incurred by incorrect declaration.

If an item from your order is damaged or broken upon receipt, you must let us know within 7 days from the day you received your item. Do not move damaged or broken items to another address. If the goods are moved from the delivery address this can invalidate your shipping insurance. In most cases, we can arrange for a courier to collect on our behalf, or can reimburse your return shipping expenses.

Manufacturer packaging is there to protect your product. Creases and small tears may occur during shipping. If you are unhappy with your product packaging you can return your item, but you may be responsible for the shipping costs when returning the item back to us.

All returns must follow the below procedures. Failure to do so may result in your return being rejected:

- Contact us in writing with your reason for the return and request a Returns Authorisation Number. Your return is not valid until you receive written acceptance from Hard To Find Records.
- Include a copy of your receipt or sales invoice showing the item(s) you are returning.
- Corresponding tape must be used when sealing any manufacturer’s boxes (e.g. boxes originally sealed with a single strip of clear tape MUST be resealed the same way).
- Cover the manufacture’s box to reduce the chance of damage and to ensure courier labels are not directly applied.
- Securely attach your returns shipping label to the exterior packaging.
- Take care to cover up any other addresses or original shipping labels on the packaging.
- Include a note confirming your ideal resolution (e.g. a refund, store credit or product details for an exchange).

Once you have received your Returns Authorisation Number, you have 14 days to send your item(s) back or to hand it over to our arranged courier. After this time, the return is cancelled and you must start the process again. This may affect your right to return the item.

Refunds are processed within a maximum of 14 days (but this will usually be within 3 working days) of Hard To Find Records receiving the goods back from you.

In the event of a refund, we will endeavour to refund returned item(s) in full including the original delivery fee. If you chose a more expensive delivery option, like next-day delivery, we are only obliged to refund the cost of the standard delivery option. We reserve the right to charge a fee (up to the full cost of the item) if the goods are not returned in their original condition.

Exceptions to this guarantee are (but are not limited to) products that degrade with use (e.g. stylus & vacuum tubes), blind/mystery boxes, SweetVinyl Sugarcubes, consumables (e.g. vinyl cleaning fluid), recordable media (e.g. reading material, computer software, DVDs, vinyl and CDs) if unsealed, special order items, customised items and unsealed products which are not suitable for return due to health protection or hygienic reasons (e.g. in-ear headphones) and defects due to accidental or deliberate damage. Guarantees may not apply in cases where the product has undergone professional use, been abused or show wear beyond what is necessary to try the goods under normal circumstances.

Product Warranties:

A warranty period takes affect from the date of delivery. We will supply goods that are free from defects in materials and workmanship for a period of 12 months (unless otherwise clearly stated).

In the unlikely event that a fault develops with your product, during normal use, within the first 30 days from your receipt of the item (provided all procedures are adhered to and the fault is confirmed upon inspection by Hard To Find Records) you will be offered a refund, store credit or an exchange free of charge.

After the first 30 days from your receipt of the item (provided all procedures are adhered to and the fault is confirmed upon inspection by Hard To Find Records) we will offer a refund, store credit, repair or exchange at our discretion.

If a returned item is deemed to be non-faulty upon inspection, the return may incur an inspection fee that must be paid before the item is returned to you.

Your warranty may become invalid due to misuse, unauthorised modifications or repairs, damage during assembly, excessive use or failure to maintain the product as per the warranty agreement.


14. Import Duty & Tax


In some circumstances, the courier or customs broker may contact you for additional information to facilitate customs clearance. As the importer, you are responsible for providing relevant information upon request. If the courier / customs broker is unable to contact you, Hard To Find Records may advise you to contact them directly. In such cases, it is your responsibility to do so. Failure to do so may result in your order being returned, destroyed or abandoned.

International shipments may be subject to local taxes and customs fees that have to be paid prior to delivery. Unfortunately, these are out of our control and are the responsibility of the customer.

If you refuse to pay these charges, your order may be returned, abandoned or destroyed. If the shipment is returned, you may be liable for the outbound and return shipping costs, which would be deducted from the value of your refund. If the goods are abandoned or destroyed, you may not receive a refund for your order.

Please check with your local authorities before placing your order with us.


15. Discount Vouchers


From time to time we may supply our customers with special discount vouchers and special offer promotions. These discounts will be available to use on the majority of our products, but not on everything we sell. We reserve the right to exclude certain products and brands from promotional offers. We will endeavour to inform you or any exceptions when you are placing your order.

We reserve the right to withdraw any offer or discount at any time and for any reason.


16. Cancellations


You may cancel any order before it has been shipped. Once your order has been shipped our returns policy will come into effect.

The only way to cancel an order is by contacting us by telephone or by email.

If you cancel an order, you should receive written confirmation of the cancellation. Your order may not be cancelled until you receive written confirmation.


17. Selling Items To Us


Please make sure the item you wish to sell to us is a 100% exact match as per our website description and offer price.

Hard To Find Records will not make payment for any product delivered to us in the following condition:

-Missing discs.
-Cover / sleeve notes not matching disc.
-Partial sleeves or missing sleeves.
-Disc or sleeve not in saleable condition (e.g. item is cracked or very badly scratched or the cover / sleeve notes are water damaged or torn).
-The product is 'non original' in any way. We do not purchase any counterfeit or bootleg discs.
-The product contains uncleared or unauthorised samples of any kind.

Once we receive your item(s) and have confirmed that it is as described, we will consider the transaction final and your payment will be arranged.

You must be the legal owner or have permission from the owner to sell your items to Hard To Find Records.

Hard To Find Records takes no responsibility for damage or loss when items are sent to us. We recommend using appropriate sturdy packaging, getting proof of postage and ensuring the shipment has a tracking number & insurance from a reputable courier.

All payments will be made by bank transfer unless otherwise agreed and will be processed within 7 working days. Payment is made based on the value offered at the time of transaction only and is subject to all your items passing our final inspection.

Hard To Find Records reserves the right to cancel your sale to us at any time without prior notice and return the goods to you at our cost. If your item(s) is not as described upon inspection, you may be responsible for the shipping costs back to you.

Customers do not have the right to withdraw from a transaction once we have received your items. At that point your transaction is final. Your statutory rights are not affected.

Minimum Quantity Requirement - We will only purchase collections which contain 20+ items or when the total value we are quoting is over £20.00.

Customers agree and expressly warrant that prior to selling their items they have not “ripped”, digitally copied or made any other type of illegal copy of the entertainment products. Furthermore, you agree and accept to fully indemnify Hard To Find Records against any potential action(s) whatsoever that may or may not be taken with regard to the sale of their entertainment products. These actions may be in relation to, but not limited to, artist rights, copyright and / or intellectual property that might or may result from the sale of the customer’s entertainment products to Hard To Find Records.

IMPORTANT: We do not purchase any counterfeit or bootleg items.


18. Copyright


No photography, imagery, text, reviews, source code or any other material from the Hard To Find Records website (www.htfr.com or mirror sites and URL's) may be copied, altered, cropped, transformed, built upon, or in any other way changed or reproduced, whether from our own websites or copied from third party websites who are in breach of this condition themselves or otherwise redistributed content without our prior written permission. Everything on the Hard To Find Records website is subject to copyright.


19. Website Usage


You may link to this website provided that you do so in a fair and legal manner. You may not create any type of link to the site if it suggests any form of association, approval or endorsement to a website where none exists.

You may not link to this website if doing so will damage or in any way harm the reputation of Hard To Find Records, the trademark owners of the products we are selling or any associated companies.

Any dispute with us will be conducted in the English language and will be subject to English law and be determined in the English courts.
