By placing an order with Hard To Find you are agreeing to the following Terms and Conditions of sale:
We do not collect or capture ANY of your financial data, and we also will never collect sensitive information about you without your explicit consent.

VINYL RECORDS & CD'S
Due to the nature of second hand records some items may contain wear, such as surface scratches or less than brand new covers. However, this should not affect the playability of the record.
All vinyl records are a mixture of new and second-hand and are fully guaranteed.
Please note we do not grade the condition of sleeves, our grading system is an indication of the vinyl only.

All hardware products are boxed and brand new unless clearly stated otherwise or are listed in our 2nd hand / ex-demo section.

ORDERS
We make every effort to ensure the vinyl records and hardware products we supply are of the highest quality, reach you in good condition, and are delivered promptly.
If for any reason you are unhappy with your purchase, or the service you have received from us, please use our contact us page located under the Info and FAQ's menu.
Orders placed over the Internet can only be processed in British Sterling.

PRODUCT DESCRIPTIONS
Many of the products we sell are of a technical nature. Unfortunately it is not practical to publish detailed specifications of all the goods and maintain up to date specifications. Thus all drawings, photographs, descriptive matter, specifications and advertising are for the sole purpose of providing illustrations and approximate descriptions only. A more detailed explanation of hardware can be obtained by contacting our hardware department. This explanation will be based on our own independent product testing and is opinion only.
Unless we are specifically asked about requirements or compatibility, we shall assume the customer is aware of what these are.
Manufacturers of the products we sell reserve the right to amend their product specifications without prior notice.

VIDEO'S & DVD'S
All video cassettes are in PAL format unless otherwise stated.
DVD's are multi-region unless otherwise stated.
Please ensure that your video/DVD player will support these formats before ordering.

COMPUTER SOFTWARE & EQUIPMENT
When returning computer equipment or computer software, the items must be as new, in a saleable condition, unused, undamaged and still in the original sealed packaging. We cannot be held responsible for any software purchased that is incompatible with your operating system or other problems specific to your computer. If the software has been registered (online or otherwise) then it is deemed as 'used' and we are unable to accept any return.

PRODUCT GUARANTEES
Products are not supplied on a trial basis.
Hardware products are covered by their respective manufacturer's warranties.
Warranty details and length are included with the product. Usually these will be for a minimum of 12 months.
Exceptions are the wear and tear on products (such as fader's and crossfader's on mixers, stylus and bulbs), professional use and neglect.

PRICES
We reserve the right to amend our prices without prior notice. All customers with outstanding orders will be notified of any change in prices before their order is charged and despatched.
All orders are accepted subject to availability of stock at the time of picking the order.
Prices are correct at the time of publication or upload to our website.
We are not obliged to supply goods to you until we have confirmed acceptance of your order. The acknowledgement email you may receive does not constitute order confirmation, or acceptance.

PURCHASING FROM US
We are unable to process your order until your payment method has been received, credit / debit / charge card has been authorised or proof of address accepted.
By submitting your order, you are offering to buy the goods, and allowing us to use your personal details for the purposes of supplying those goods (including passing your personal details onto couriers and other subcontractors). Personal details can be removed from our system by written request.
We never debit your credit / debit / charge card for items not in stock, and your card is only charged when your order is ready for despatch. This excludes payments sent via Paypal, bank transfer, cheque, cash and postal order. No items or title of the goods shall pass from us to the customer until payment has been received in full.
Customers are responsible for the suitability of the goods they are purchasing. If any product supplied is not used for its intended purpose, subjected to abuse, or unreasonable usage will void the warranty on the goods.
Customer may use our currency converter as an estimate only. Please contact bank, paypal or your card issuer for their exact exchange rate and/or any other charges.
Please note we do not reserve any items at any time as it is unfair to other customers

PRICE PROMISE DESCRIPTION
We will try to beat or at least match the price on any product (excluding vinyl) that we sell against any authorised UK dealer (*) who has the same product in-stock (including all shipping and other charges).
If we are able to successfully price beat or price match we will also send you a free DJ watch for your trouble.
* Authorised Dealers are retailers who deal directly with manufacturers and/or their official distributors. Therefore authorised dealers are equipped and committed to providing excellent representation of the brands in question with full product, service and sales experience, with trained staff and the benefit of having the products on demonstration in a dedicated retail store, as we offer. Authorised Dealers offer the full manufacturer's warranty, with the guarantee of genuine products that are intended for the UK market.

AVAILABILITY OF GOODS
We go to great lengths to ensure that everything shown on our website and catalogue is available to order is in stock. However, due to the nature of our business, dealing in a huge selection of mainstream, rare, deleted and unavailable records it is inevitable that some of our vinyl can go out of stock very quickly. We stock over 100,000 items and it is sometimes very difficult to keep every item in stock at all times. We are sometimes dependent on our own suppliers to deliver stock to us.
Please be aware that our store is also open to the general public to purchase. All orders and special offers are therefore subject to the availability of stock when picking your order. All items are sold on a first come, first served basis so that all customers are treated fairly. Unlike most of our competitors our website is updated every minute or sooner with the latest products and stock availability.
We will always try to inform you if an item is not in stock when you place your order with us. When we receive your order we will ship everything that is in stock.
Should any items be out of stock a carefully selected upgrade or replacement may be offered or sent should the circumstances and criteria suffice. Any items that are not in stock, and no suitable alternative be available at the time of picking, your order will be dealt with as per Section 13.

BACK ORDERS
If an item is out of stock and a credit / debit / charge card has been used to place the order, we will automatically make you a back order. If the goods return into stock within 12 weeks they will be sent straight out with no additional shipping charges, only a handling/backorder charge as indicated on our shipping page.
However after the 12 week period we will notify you by email when the goods return to stock. You must then re-order the goods by placing a fresh order. You may cancel your back order at any time at no cost and with no penalty by contacting us via phone or email. As with all orders you will only be charged when items are ready to be despatched to you unless you have paid via Paypal, bank transfer, cheque, cash or postal order.
Please note that if you do not cancel your back orders, they will remain an on-going order with us. When cancelling a back order with us please make sure you receive confirmation from us that it is cancelled.
All back orders will be shipped to you via our Silver / Gold delivery method (which ever the item requires) to your requested delivery address at the time you submitted your order.
Customers who haven't paid by credit / debit / charge card will be notified by email when the item(s) become available again so they may place a fresh order for the item(s) if they wish to do so. This email notification service is FREE and there is no obligation to purchase the item(s).
Please note that we do not reserve stock at any time as this is unfair to other customers.

IF YOUR CARD PAYMENT DECLINES
Should your card payment be declined or not authorise we will continue to try and authorise the order with the card details you supplied at point of transaction.
Please contact your bank to resolve any outstanding issues you may have with them.
Unless we receive official cancellation of the order from the card holder, we may re-try the card details and attempt to get authorisation for a maximum period of 28 working days after the initial order was placed.
Unfortunately we are unable to reserve stock while waiting for payment to authorise.

CREDIT / DEBIT / CHARGE CARDS
Credit, debit and charge cards are accepted without surcharge.
When we receive your order, your payment card will be pre-authorised with your bank. Pre-authorisation locks funds in your account for up to 7 days so that we may charge your card when your order is ready for despatch. Please note that we only charge your card when your order is ready to be shipped.
We reserve the right to deliver any order to the cardholders billing address in the interests of protecting both the card holder and this company against credit / debit card fraud.
Orders sent to a non card registered address are sent at the customers liability due to the higher risk of card fraud and a third party obtaining your order when sending to a third party address. If requesting an alternative delivery address please state this on your order, along with your card registered address.
In the interests of protecting all our customers against credit card fraud, you may be asked to provide us with proof of your address at anytime. If you refuse to provide us with this evidence, your order may be cancelled.
If you are using a credit card not belonging to yourself, you must give the cardholder's full name and address. We will then contact the cardholder to obtain approval.
The use of stolen credit cards will result in international police notification and court action in all cases.
Items that were purchased from the store can only be refunded from the store using the original credit/debit card.

CHEQUES
Personal or business cheques are welcomed but clearance is required prior to order shipping. This can take up to 10 working days from when we receive the cheque.
Please note we only accept UK cheques.
Unfortunately we are unable to reserve items whilst waiting for cheque clearance. If the item ordered is in limited supply, please include alternative items when ordering so that we can easily substitute your first choice to avoid any disappointment.
IMPORTANT: Please ensure that you have written your full name and address on the back of the cheque together with your customer id number (if applicable).

BANKERS DRAFTS, BUILDING SOCIETY CHEQUES, POSTAL ORDERS, CASH, PAYPAL & DIRECT MONEY TRANSFERS
The above payment methods are acceptable and should clear immediately upon receipt.
We accept cash sent by insured delivery. We accept UK Pound Sterling, Euros, American Dollars, Canadian Dollars, and Australian Dollars.
Please note that we can't be held liable for any money lost in the post. Please do not send coins, we only accept notes.
You may also transfer funds (or pay cash) directly into our bank account.

Please be aware that we are unable to reserve stock, while waiting for payment, or for payment to clear due to being unfair to other customers.

SHIPPING
All records are mailed in strong cardboard envelopes. All other orders are shipped in appropriate strong packaging. Unfortunately, due to shipping regulations we are unable to ship liquid and/or aerosols to an overseas address. Orders are computer tracked with barcodes and can be followed up at any time by contacting us.
Orders shipped by courier can be tracked on our website via our tracking section. This is located under the Info and FAQ's menu. Most other orders can be tracked using the tracking info available on the despatch email we send you when your order leaves our warehouse.
We advise you to ensure somebody is present at the delivery address since some items may require a signature upon delivery. Once goods are delivered and signed for they become your responsibility.
Orders sent to a non card registered address are sent at the customers liability due the higher risk of a third party obtaining your order when sending to a third party address.
We reserve the right to alter the shipping option of an order in the case of certain items not being in stock. This will only be implemented on rare occassions to save you money on postage charges.
If in the unlikely event that your order is damaged or lost in transit, a replacement order will be issued. If we cannot supply an identical order we will issue you with store credit to use at a later date.

SHIPPING TIMES
Our orders are shipped and handled by third party couriers, therefore all delivery dates and times given are only estimates.
We endeavour to get your order to you within the estimated delivery time, however, on rare occassions the delivery may be delayed. We therefore cannot be held responsible for delays by the courier / postal service or for any consequential losses you may suffer if the delivery is not on time for whatever reason.
Orders being shipped to remote locations may, on rare occassions, be slightly delayed by the courier / postal service.
Please also see section 21 if you are a UK customer or section 22 if you are a customer outside the UK for more shipping info.

SHIPPING CHARGES
Charges will be calculated on our website for online orders or quoted by telephone when ordering by traditional mail order.
If your order is returned to us undelivered due to your own fault you will be responsible for the re-shipping charges.

DISTANCE SELLING: YEAR 2000 REGULATIONS
This regulation only covers countries that are member states of the EU. If you are ordering from a member state of the EU other than the UK please check you countries regulations on Distance Selling as this may vary. If you are ordering from a country that is outside of the member states of the EU this regulation is not applicable, but we will do our best to adhere to these guidelines in the way your returns are dealt with.
You have the right to return any item ordered via this website for no reason and without penalty for a refund. This excludes consumables and worn items i.e. stylus. Alternatively, you can send us a fax on +44 (0) 121-687 7774 or e-mail us using this page stating your ID number and cancellation instructions. We shall refund the total amount of money paid by you for the goods, less any costs to collect the goods if required, within 30 days starting from the day on which we receive notice of cancellation in writing from you and subject to the goods being correctly returned as detailed below.
If you are returning an item under Distance Selling, you are responsible for the return shipping costs
Please note that any items returned under the Distance Selling Year 2000 Regulations will require a Returns Authorisation number (RAN) and be returned as per our standard returns procedure.

FINANCE AGREEMENTS
Finance is only available to UK customers over 18 years of age. We can only accept finance applications in store. If you have paid for your order by finance then your contract will be with our finance Company. Full details will accompany your finance agreement.

UK CUSTOMERS
Most orders can be tracked using the tracking info located on the despatch email we send you when your order leaves our warehouse.
In the unlikely event that your goods do not arrive within 7 days of despatch, first call or e-mail us to confirm your order has been shipped and that we have your correct delivery address details.
Normal delivery time after dispatch is approximately 1 to 4 days. However, please allow up to 14 working days during busy periods e.g. Christmas.
Unfortunately parcels can not be declared lost in post until 15 working days have elapsed from the shipping date. We therefore cannot replace your order until the courier or postal services have confirmed that your parcel has been lost/damaged.

OVERSEAS CUSTOMERS
Most orders can be tracked using the tracking info located on the despatch email we send you when your order leaves our warehouse.
In the unlikely event that your goods do not arrive within 29 working days of despatch, first contact us to confirm shipping of your order and all delivery details are correct.
Unfortunately parcels can not be declared lost in post until 29 working days have elapsed from the shipping date. We therefore cannot replace your order until the courier or postal services have confirmed that your parcel has been lost/damaged.

IMPORT DUTY & TAXES
It is your responsibility as the customer to pay all applicable customs fees and taxes for your country. If you refuse to pay these charges then your order may be abandoned and you will lose your goods as well as your money. These taxes are only applicable for non UK and non European Union countries.

DISCOUNT VOUCHERS
From time to time we will supply our customers with special discount vouchers and special offer promotions. These discounts will be available to use on the majority of our products, but not all. Certain products and brands will be excluded from promotions, see here.
When placing your order you will be told/contacted if the discount is not available on that particular product.
We reserve the right to withdraw any offer or discount at any time.

CANCELLATIONS
You may cancel any order before it has been shipped. Once your order has been shipped our returns policy will then come into affect which is located under the Info and FAQ's menu.
Please note that the only way to cancel an order is in writing / email. If the order is to be cancelled, please call us to inform us of the intended cancellation, but then it has to be confirmed in writing / email.
If you cancel an order by email you must wait to receive a confirmation of the cancellation. Your order is not cancelled until you receive this.

LATE PAYMENTS AND BAD DEBT
In the event that cheques have to re-presented for payment to the buyers bank, the seller reserves the right to pass on all associated bank charges. Further the seller reserves the right also to charge interest at the rate of 8% above prime overdraft rate on all payments outstanding for more than 30 days following month of invoice.
If handed over for collection of debts, the debtor will be liable for all legal and collection fees.

EXCEPTIONS
1) Please note your right to return an item unwanted for a refund under the distant selling regulations does not apply to Computer Software, Video / DVD / inner ear headphones or Audio recordings (including vinyl and cd's) that have been unsealed by the consumer. However you do have the right to cancel any order before it has been shipped.
1) Your right to return an order for a refund does not extend to customers who purchase from our store. You have the right to return goods ordered and collected from our store within ten working days for an exchange or credit note.
3) Our guarantee will be null and void if the item has been interfered with in any way by any unauthorised party, or misused in any way. Damage caused by external sources will not constitute a part of this guarantee and is therefore excluded.

We may use any personal information that you provide us with to register you with our website and to subscribe you to our email newsletters
Any personal details provided whilst using the website may be deleted, at your request, at any time.
You are able to unsubscribe yourself from any email newsletter either by clicking the 'Unsubscribe' link contained in the mail, by visiting your online profile and managing your subscription, or by contacting us using the Contact Us page of the website.

SELLING ITEMS TO US
Market Value & Inspection
Please make sure the item you wish to sell to us is a 100% exact match to the list. Items on wrong labels or formats will be priced to Market Value.
All items that are listed as Market Value will be inspected by our buying team and priced accordingly. The typical price for any item will be from £0.05 per unit.
All vinyl & CDs are checked by our buying team. Hard To Find will not make payment for any product delivered in the following condition:
- Any of the vinyl or discs from the original item are missing.
- The vinyl or disc in the case does not match the cover or sleeve notes.
- Some or any of the cover or sleeve notes are missing.
- The cover, sleeve notes or the disk are irretrievably damaged and cannot be refurbished e.g. the vinyl or CD is cracked or very badly scratched or the cover or sleeve notes are water damaged or torn.
- We suspect the product is 'non original' in any way. Please be aware that we do not purchase any counterfeit or bootleg records or CDs.
Customers do not have the right to withdraw from a transaction once we have received your items in our warehouse, at which point your transaction is final. Your statutory rights are not affected.
You must be the legal owner or have permission of the owner to sell your items to Hard To Find.

Postage
Hard To Find take no responsibility for damage or loss for items sent to us.
Customers are recommended to get proof of postage from the Post Office or courier you use.
To ensure payment is made quickly you are recommended to send your vinyl & CDs in correct packaging.
Please ensure that the address label we provide is clearly placed on the outside of the box.
Payment
All payments are made by company cheque and will be processed within 7 working days.
All payments include VAT at the current UK rate.
Payment is made based on the value offered at the time of transaction only and is subject to all your items passing the final inspection.
Usage
Hard To Find reserve the right to cancel your sale to us at any time without prior notice.
Customers agree and expressly warrant that prior to selling their vinyl & CDs that they have not "ripped", digitally copied or made any other type of illegal copy of the entertainment products that the customer is selling and furthermore agree and accept to fully indemnify Hard To Find against any potential action or action(s) whatsoever that may or may not be taken with regard to the sale of their entertainment products in relation to, but not limited to, artist rights, copyright and/ or intellectual property that might or may result from the sale of the customers entertainment products to Hard To Find.
Minimum orders
The smallest quantities we will purchase are 20 items or when the total value is over £20.00.
